1. Introduction
Stanley Marketing is a trading name of Waitapu Group Limited ("we", "us" or "our"). These Terms explain how we handle website enquiries and the conditions we propose for our products and services.
Browsing this website, adding services to your cart or completing the checkout preview does not create a service contract, accept a quote or require payment. These Terms apply to a service agreement when they have been provided to you before acceptance and agreed as part of that agreement.
The 7-day satisfaction guarantee applies despite any other cancellation, refund or liability term in these Terms. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.
2. Definitions
- Services means the marketing, design, website, content and automation work we agree to provide.
- Products means agreed deliverables, materials or goods supplied as part of that work.
- Quote means our written offer describing the scope, price and other project terms.
- Service agreement means the accepted quote, agreed brief, mutually agreed project terms and the version of these Terms agreed before acceptance.
- Booking means an accepted service agreement, not an item in your cart or an unsent enquiry.
- You means the person or business entering a service agreement, or the website visitor where the context concerns website use.
- In writing includes email. Calendar days include weekends and public holidays; working or business days exclude weekends and New Zealand public holidays.
3. General Conditions
Before accepting a job, we confirm in writing its scope, deliverables, price including any GST, approved add-ons and third-party charges, delivery arrangements and payment terms. A service agreement is formed when you accept that written offer in the manner specified in it. A checkout preview alone does not book work.
You must be at least 18 to enter a service agreement and authorised to act for any business you represent. Please provide accurate information and the content, access and feedback reasonably needed for the agreed work.
Changes to scope, price, timing or other project terms require both parties' written agreement. We will explain additional work and its price before you decide whether to proceed. We will not incur additional expenditure on your behalf without your agreement.
We may decline an enquiry before accepting a job. After acceptance, we may pause or end work only on lawful grounds or as agreed. We will explain the reason and, where it can reasonably be remedied, give reasonable notice and an opportunity to resolve it. If we cancel without your fault, we will refund amounts paid for work not supplied and honour any further legal remedies.
4. Products and Services
We provide the agreed work with reasonable care and skill. Availability, package inclusions, file formats, platform access, support and any ongoing obligations are confirmed in the quote. A future change to our offers does not change an accepted job.
Website images illustrate services and creative work; they are not a promise of a particular deliverable or result. We aim to describe offers accurately. If a material error affects a quote or accepted job, we will explain it and resolve it with you consistently with your legal rights.
Some services use AI-assisted production or third-party platforms. We will explain their material role and limitations in the agreed scope and check the work for its agreed use. AI output may not be unique, exclusive or eligible for copyright protection. AI use does not remove our responsibility for reasonable care and skill or your legal remedies.
We do not guarantee particular sales, revenue, search rankings, reach or engagement. This does not reduce our responsibility to supply the agreed scope, honour an expressly agreed outcome, provide lawful remedies or honour the 7-day satisfaction guarantee.
Platform subscriptions, advertising spend, domain names, hosting, stock licences and other third-party costs are included only where the accepted quote expressly includes them. Any relevant third-party terms or material restrictions will be identified before acceptance; they do not exclude our own responsibilities.
5. Pricing and Payment
Advertised prices are in New Zealand dollars and exclude GST unless stated otherwise. Where GST applies, the checkout preview shows it separately. The final quote confirms the total payable, including GST and agreed charges.
Prices identified as placeholders are indicative examples for discussion, including package and add-on prices. Items requiring a quote are not included in the preview total. A displayed price covers only its named package and stated inclusions. Add-ons require agreement; they are not automatically included.
This website does not take payment or collect card details. Payment is due only under an accepted quote or service agreement, using the method agreed for that job. Do not email card details or passwords. No payment processor, card authorisation or recurring billing is connected to this checkout preview.
Selecting a monthly extra does not start a subscription. Before ongoing work begins, we agree its scope, GST-inclusive fee, billing frequency, start date, duration and cancellation arrangements in writing. One-time and recurring charges are separate.
We may update prices for future offers. Accepted prices change only by mutual written agreement. Late-payment charges apply only if expressly agreed beforehand, reasonable and lawful.
Promotional discounts apply to the stated package and period. For the website offer ending Friday 16 October 2026 at 5pm NZDT, an enquiry sent to us by that deadline for the stated one-page base scope qualifies for the advertised 50% discount. We confirm that discount and the agreed scope in the quote. Optional extras, domains, hosting and recurring charges are separate. Sending an enquiry does not itself create a service agreement or require payment.
6. Delivery
The advertised delivery time covers the agreed base scope. It starts when scope is agreed, required payment and a completed brief have been received, and all necessary content and access are available. AI UGC video also requires an approved presenter. We confirm timing for larger packages, add-ons and ongoing work in the quote.
If required content, access or feedback is delayed, we will explain the effect and agree a revised schedule. If an external issue causes delay, we will notify you, take reasonable steps to reduce its effect and discuss the revised arrangements. These provisions do not remove remedies for a missed agreed deadline or any other legal rights.
Your approval or instruction to publish confirms your approval of that stage of the work. It does not waive the 7-day satisfaction guarantee, responsibility for errors in our work, or legal remedies. Changes outside the agreed scope will be quoted before proceeding.
7. Termination, Cancellations and Refunds
7-day satisfaction guarantee: If you are not 100% happy with your completed work for any reason, contact [email protected] within 7 calendar days of receiving that completed work. We will refund in full the amount paid to Stanley Marketing for the relevant agreed service, including any GST paid on it. We will not deduct administration or payment-processing fees. You do not have to accept investigation, repairs or corrections before claiming this guarantee.
This guarantee is additional to your legal rights. The seven-day period does not end any rights or remedies available under applicable law. An agreed project term cannot reduce this guarantee.
You may cancel an undelivered booking within 48 hours of entering the service agreement and receive a full refund if you have not submitted the brief. For a customer-requested cancellation after that point, we may charge only for agreed work already completed and reasonable, documented non-recoverable costs incurred for that job. We will explain those amounts and refund any remaining balance. This does not restrict remedies for our failure to meet an obligation or override the guarantee for completed work.
If you report an issue with our work, we will discuss the outcome you want and provide the remedy required by law. We can offer corrections without charge where an error is our responsibility, but this process cannot prevent an immediate refund under the guarantee or delay a remedy you are legally entitled to choose. Additional work outside our responsibility and scope requires a separate agreed quote.
Contact [email protected] to cancel or request a refund. Eligible cancellation refunds and guarantee refunds will be processed within 10 business days of your request, subject to any shorter period required by law. Payment-provider processing time may affect when funds reach your account.
If a required brief or response is missing, we will contact you and may pause the job. After 30 days without it, we may cancel the undelivered job after reasonable notice. Only agreed completed work and reasonable, documented non-recoverable costs for that job may be charged; any balance will be refunded. Your guarantee and legal rights remain unaffected.
8. User Obligations
Use the website and our work lawfully. Do not interfere with website security or knowingly provide unlawful, misleading or infringing material. Please ensure business claims you supply are accurate and can be substantiated, and obtain any necessary rights or permissions for supplied text, logos, images, voices, testimonials and identifiable people.
Provide only personal information needed for the project and discuss the intended use with us before sharing customer lists, recordings or sensitive information. We must separately meet our own privacy obligations; a client's instruction or approval does not override the law.
Where account access is needed, we will agree a suitable way to provide it. Do not put passwords or card details into website enquiries. Your obligations and approval do not excuse errors in our own work or reduce non-excludable rights.
9. Intellectual Property
You retain rights in materials you supply. You authorise us to use them as needed to carry out the agreed job, subject to your rights and the agreed scope.
Before work starts, the quote will identify the final deliverables and files to be supplied, any agreed ownership transfer or licence, relevant payment conditions, and third-party restrictions. Source or editable files, unused concepts and ongoing software access are included only where agreed. If no different ownership arrangement is agreed, ownership is determined by applicable law, including any relevant commissioned-work copyright rules.
Existing tools, reusable templates, methods and third-party software, fonts, photographs or other licensed assets retain their respective ownership. We will identify licences or permissions needed for the agreed use. We cannot transfer rights we do not hold or promise exclusive rights in third-party or AI material. Trademark registration or clearance is included only if expressly agreed.
Any payment condition for the rights in a project relates to that project; we will not withhold rights in a paid project solely because a separate job is unpaid. We will seek permission before publicly featuring your confidential material or new client work, unless its publication has already been authorised.
Website text, branding, images and client logos belong to their respective owners or licensors. You may use them as authorised by their licence or applicable law; other reuse requires the relevant owner's permission.
10. Privacy
Our Privacy Policy explains website enquiry information, hosting, permitted use and disclosure, overseas processing, retention, access, correction and complaints. Reviewing these Terms is not blanket consent to unrelated marketing or unrestricted data use.
Before a project involves customer databases, AI tools, chatbots, voice recording or other processing of personal information, we will agree responsibilities, purposes, providers and relevant safeguards. The website currently runs none of those customer-facing systems and does not process payments.
11. Liability and Your Legal Rights
We remain responsible for supplying the agreed work with reasonable care and skill. Available rights and remedies for a failure or resulting loss are determined by the service agreement and applicable law. These Terms do not impose a blanket exclusion of liability or an automatic liability cap.
Where the Consumer Guarantees Act 1993 applies, its guarantees and remedies continue to apply, including those concerning care and skill, an agreed purpose, and reasonable time or price where not agreed. These Terms do not automatically contract out of that Act for business customers.
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited, including under the Fair Trading Act 1986. The 7-day satisfaction guarantee applies despite any other cancellation, refund or liability term.
12. Governing Law and Disputes
New Zealand law governs these Terms. A dispute may be brought before a court or tribunal with lawful jurisdiction. Any mandatory legal protections that apply to you remain available.
Please contact [email protected] about a concern so we can try to resolve it promptly. We will aim to discuss it within seven working days. Mediation is available if both parties agree. Neither discussion nor mediation is a mandatory barrier to a court or tribunal claim, a complaint to an authority, or urgent relief.
13. Changes to Terms and Conditions
We may update these Terms for future website enquiries and future jobs. The version and update date will be published here. An accepted service agreement remains governed by the terms agreed before acceptance unless both parties agree in writing to change it. A website update alone does not change an existing contract.
14. Contact Information

15. Severability
If a provision cannot lawfully be enforced, it applies only to the extent permitted by law or is removed to that extent. The remaining provisions continue where they can lawfully do so. This does not remove a statutory right or give either party the power to rewrite an agreement unilaterally.
16. Your Service Agreement
The accepted quote, agreed brief, mutually agreed project terms and the version of these Terms agreed before acceptance form the service agreement. Mutually agreed project terms prevail over a conflicting general term, except that they cannot reduce the 7-day satisfaction guarantee or non-excludable legal rights.
Changes require both parties' written agreement. This clause does not exclude responsibility for misleading statements or remove rights and remedies under applicable law.
17. Waiver
A delay or failure to enforce a right does not by itself waive that right. A waiver of a contractual right must be clearly agreed and applies only to the matter agreed. It does not waive a right that cannot lawfully be waived.
